General Terms and Conditions of the Contact+ Service

Version 2026-11-05, effective from 5 November 2026

This English version is a translation; the Slovak version is binding.

Article 1 — Who we are and what these terms govern

1.1 The Contact+ service (the “service”) is provided by RESINOS & GO UP SYSTEMS INC., with its registered office at 228 Park Ave S #86399, New York, NY 10003, USA, EIN 981914999, NYBE ID 265604920 (“we”, “us”). We are both the provider of the service and the seller of everything you order in it. Contact: e-mail quick@plus.contact, telephone +421 910 468 787. At this e-mail address and at the address of our registered office we also accept complaints, withdrawals from the contract and requests for redress.

1.2 Our representative in the European Union under Article 27 of Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and our legal representative under Article 13 of Regulation (EU) 2022/2065 (Digital Services Act, DSA) is ERIOS, s.r.o., IČO 29789770, Rybná 716/24, Staré Město, 110 00 Praha 1, Czech Republic. You may also send documents intended for the representative to quick@plus.contact; in matters concerning the representative you may also call us at +421 910 468 787.

1.3 These general terms and conditions (the “terms”) govern registration, use of the service, subscriptions to packages, top-up purchases of AI credits and avatar videos, advertising through Contact+ paid from advertising credit, and advertising in the own ad account of a company with the Enterprise package (Article 15). They apply to businesses and to consumers alike. Provisions marked “Consumers only” apply only if you are a consumer, and provisions marked “For businesses” only if you are a business (Article 3).

1.4 These terms do not narrow the rights that the law gives you as a consumer. Should any provision deviate from the law to the detriment of the consumer, the law applies.

1.5 The terms are published at https://plus.contact/en/podmienky; the same text is also available in the service at https://app.plus.contact/podmienky.

Article 2 — Definitions

  • customer — the party with whom we conclude the contract: a legal entity or business on whose behalf someone has registered in the service, or a natural person who has registered for themselves; in the service it is kept as a “company”. Performance ordered in the service by a user of the company is ordered on behalf of the customer;
  • consumer — a natural person who, when concluding and performing the contract, is not acting in the course of their business activity or profession;
  • business — a customer who is not a consumer;
  • user — a person with their own named account who works in the service for a company;
  • owner — a user with the company owner role; the owner orders, changes and cancels subscriptions, downloads all company data and cancels the company;
  • package — the free Start package, the paid Basic, Profi and Team packages, and the Enterprise package under an individual contract (Article 7.8);
  • price list — the public overview of packages and top-ups with prices in euros at https://plus.contact/en/cennik (the same price list is also available in the other language versions of the website) and in the service in the section Packages › Price list;
  • subscription — a contract for a paid package;
  • period — the monthly or annual billing period of a subscription;
  • allowance — the AI assistants, AI credits and avatar videos credited to the company for a month according to its package;
  • top-up — a one-off purchase of AI credits or avatar videos in addition to the allowance;
  • upgrade charge — the pro-rata part of the price difference that you pay when changing to a higher package during a period (Article 11.1);
  • promo code — a code that gives a discount on the package price when you order a subscription (Article 8.7);
  • ad account — an account in Google Ads or in Meta (Facebook, Instagram) from which your advertising runs: for advertising through Contact+, an account we keep for your company (Article 15.1); with the Enterprise package, your own account that you connect to the service and from which you pay for advertising directly to Google or Meta (Article 15.4).
  • advertising credit — a refundable deposit that you top up by card and from which you pay for advertising through Contact+ including the management fee (Article 15.2); it is not AI credits.

Article 3 — We sell paid services to businesses

3.1 We sell paid services — subscriptions, changes to a higher package, top-ups and advertising credit — only to businesses. With every such order you tick the pre-unticked box “I am buying for the purposes of my business or profession.”; without it you cannot submit the order.

3.2 We record the ticked box with the order; for a concluded contract, your status at the time of its conclusion applies. If you nevertheless order as a consumer, you have the rights that the law and these terms give to consumers (in particular Article 16).

3.3 Registration and the free Start package are governed by Articles 6 and 8.5 regardless of this box.

Article 4 — Pre-contractual information (consumers only)

4.1 Before you submit an order, we inform you in the price list, in the order summary and in these terms of:

  • the main characteristics of the service and the package, its functionality, compatibility and updates (Article 5 and the price list);
  • our business name, registered office, telephone and e-mail (Article 1);
  • the final price per period or per top-up and any further payments (Article 9);
  • the payment terms and from when we provide the service (Articles 7 and 9);
  • liability for defects and the complaint procedure (Article 18);
  • the duration of the commitment, automatic renewal and the conditions for cancellation (Article 10);
  • the right of withdrawal, its conditions, time limit and procedure, where the withdrawal function is, when you pay for performance provided and when the right expires (Articles 16 and 17, the information notice in Annex 1a and the model form in Annex 1b);
  • requests for redress and dispute resolution (Article 23).

4.2 For a subscription, immediately before the order button we repeat what you are ordering, the final price per period, the first payment, the minimum duration of the commitment, that the subscription renews automatically and how you cancel it; if you have applied a promo code, also the discount, the first payment after the discount, the further payments and how long the discount lasts (Article 8.7). For a top-up, before payment you see the item, its price and its validity period.

4.3 This information forms part of the contract. With a subscription order we store the version of these terms and a record of the boxes you ticked, and we send them to you in the order confirmation (Article 7.4). With a top-up we store the item, the price, the time of payment and the invoice.

Article 5 — The service, its characteristics and limitations

5.1 Contact+ is a web application at https://app.plus.contact for contact management, e-mail sequences, AI texts, signatures, social media posts, avatar videos and advertising on Google and Meta. The features and limits of the packages are set out in the price list. A feature that the price list or the service marks as “Coming soon” is not part of the performance until we make it available in the service; making it available is not a change under Article 13.

5.2 To use the service you need a current version of a common web browser (for example Chrome, Edge, Firefox or Safari) and an internet connection. To send e-mails you need your own e-mail mailbox with SMTP access; e-mails are sent from your mailbox. For live campaigns you also need IMAP access to the mailbox from which the service reads the recipients' replies. The service publishes posts in your own social media accounts that you connect to it. Advertising can be launched only from your own ad account in Google Ads or Meta (Article 15).

5.3 Limitations of the service:

  • the number of contacts, users, e-mails per day and other limits are determined by the package; above the limit the service does not add new items (but deletes nothing) and sends e-mails above the daily limit on the following days;
  • by default the service only simulates e-mails; you switch live sending on yourself;
  • campaign e-mails do not go out live until you fill in, in the company settings, the sender address, the sender identification in the footer, the signature and the address of your own privacy policy, and confirm the legal basis for contacting recipients (Article 20.2);
  • into every campaign e-mail and every standalone e-mail the service inserts an invisible image to measure opens, and links in the e-mail text (except the unsubscribe link and links whose text shows the address itself) are routed through a redirect at https://link.plus.contact to measure clicks; the measurement cannot currently be switched off. Whether you need the recipients' consent for it under the rules on electronic communications (in Slovakia, Section 109 of Act No. 452/2021 Coll. on Electronic Communications, in Slovak zákon č. 452/2021 Z. z. o elektronických komunikáciách) is for you to assess (Annex 2, point 2.10);
  • posts are not published live on the networks until you confirm live publishing in the company settings;
  • the service deletes the files of videos that you have published or rejected from the server after 30 days; the video record in the service and the video published on the network remain. If you want to keep the file, download it earlier;
  • the supplier of avatar videos may refuse a photo or recording from which a character or voice is to be created;
  • we do not guarantee delivery of e-mails to the recipient's inbox (rather than to the spam folder); it also depends on your mailbox, domain and the content of the e-mails;
  • texts, drafts and videos prepared by artificial intelligence are drafts and may contain errors; check them before use;
  • advertisements are approved by Google or Meta and may be rejected by them; the number of impressions, clicks or other advertising results are not guaranteed.

5.4 We update the service continuously and free of charge, including security updates, throughout the term of the contract. Updates take effect automatically; you install nothing.

5.5 When a consumer reports a defect, the consumer provides us with reasonable cooperation to establish whether the cause lies in their device or connection (description of the error, browser, screenshot). Cooperation is limited to the means that burden you the least. If you do not provide cooperation although we have asked you for it and this Article informs you of this obligation, the burden of proving that the service had a defect lies with you.

5.6 We provide the service continuously, except for necessary maintenance and outages beyond our control (for example a supplier or network outage). Where possible, we carry out planned maintenance outside working hours. We do not guarantee availability as a percentage; your rights under Article 18 are not affected by this.

Article 6 — Registration and account

6.1 Only a person who is at least 18 years old and has full legal capacity may register, whether for a company or as a natural person, including a consumer. On registration you enter the company name or your own name, your name and e-mail, and tick your agreement to these terms, by which you also confirm that you are at least 18 years old; the Data Processing Agreement (Annex 2) is part of the terms. How we process your personal data is described in the privacy policy (Article 22). You complete registration within 24 hours using the link from the e-mail and by setting a password.

6.2 Registration creates a company in the free Start package. With your agreement we store the version of these terms and a fingerprint (SHA-256) of their text, so that it can be proven which wording you agreed to. One user account may be the owner of at most one company in the free package; a cancelled company also counts until we delete its data.

6.3 Do not give your login details to anyone; every user should have their own account. If you discover that they have been misused, notify us without delay and change your password.

6.4 Whoever registers on behalf of a company or invites further users into the company confirms that they are authorised to do so.

Article 7 — Conclusion of the contract

7.1 We conclude the contract for the free Start package upon completion of registration, that is, by setting a password from the link in the e-mail (Article 6.1). We conclude a paid contract (subscription, change to a higher package, top-up) by an order in the service, and the Enterprise package under Article 7.8. What can be ordered in the service is set out in the price list; an item marked “Coming soon” cannot be ordered yet.

7.2 You order a top-up in the section Packages › Top up: you select the item, tick the box under Article 3 and pay with the “Pay by card” button on the Stripe payment page; any user of the company may make a top-up from their own account. A user who is not the owner makes the top-up on behalf of the customer; the customer is the contracting party. The company owner orders a subscription from their own account as follows:

  • 1. in the price list or in the Packages section you select a package and a period;
  • 2. in the summary you check what you are ordering, the final price, the first payment, the period, automatic renewal and the minimum duration of the commitment; here you apply a promo code with the “Apply code” button, and the summary then shows the discount and the price after the discount (Article 8.7); you correct errors with the “Change” button;
  • 3. you tick the box under Article 3 and the box under Article 7.6;
  • 4. you submit the order with the “Order with obligation to pay” button and pay by card on the secure Stripe payment page.

7.3 The contract is concluded when the payment gateway confirms a successful payment. Without it, no contract is formed and the company remains in its current package.

7.4 We confirm a subscription order and a change to a higher package by e-mail to the address of the account from which you ordered, without delay after payment. The confirmation contains what you ordered, the price and the period, with a promo code also the code, the discount, its duration and the first payment after the discount (Article 8.7), the seller's details, a record of the boxes you ticked when ordering, with the date and time, and, as an attachment, the wording of these terms in HTML format, including the information notice on withdrawal and the model form. If you are a consumer, it also contains a link by which you can withdraw from the contract without logging in (Article 17). You will find a top-up with its expiry date and invoice in the section Packages › Top up under Your purchases; the company owner also sees invoices in the section Packages › Invoices. On request, we will e-mail you the wording of these terms that applied at the time of the top-up.

7.5 Consumers only — start of performance during the withdrawal period. We sell paid services only to businesses (Article 3), so the order has no box requesting the start of performance during the withdrawal period. If you nevertheless order the service as a consumer, we start performance after payment and, if you withdraw in time, we refund the full payment.

7.6 For a subscription, you tick the pre-unticked box: “I request automatic renewal of the subscription and agree to recurring payments at the beginning of each period until I cancel the subscription.” Without it, a subscription cannot be ordered.

7.7 We conclude the contract in Slovak. If we publish the terms in another language as well, the translation is for information only and in the event of a conflict the Slovak wording prevails; if you are a consumer, the wording that is more favourable to you applies. We keep subscription orders together with the version of the terms you agreed to and the record of the boxes ticked; the company owner can find them in the section Packages › Invoices. You receive the wording of the terms as an attachment to the order confirmation (Article 7.4); on request, we will e-mail you the wording that applied at the time of an earlier order.

7.8 You cannot order the Enterprise package in the service yourself or pay for it by card. We conclude it by an individual contract: the price, limits and period are determined by the contract and it is paid by invoice outside the payment gateway. These terms also apply to Enterprise unless the individual contract provides otherwise.

Article 8 — Packages, allowances and top-ups

8.1 The content of the packages (users, contacts, e-mails per day, social media accounts, storage, characters, allowances) and the prices are set out in the price list. The price list as worded at the time of the order applies to your contract; changes are governed by Articles 12 and 13.

8.2 The allowance is credited after payment for the period and is valid until the end of the monthly period for which it was credited; the unused part then expires. With an annual subscription, the allowance is credited for each month of the paid year. The allowance of the free package is credited once per calendar month. An avatar video of up to 60 seconds uses one video from the allowance; a longer video uses one video for each minute started.

8.3 You buy avatar videos and AI credits as one-off top-ups; the bundles and their prices are set out in the price list. Topped-up AI credits and videos are valid for 30 days from payment; the unused part then expires. Whatever expires first is used first. You can see the expiry date next to the purchase in the section Packages › Top up under Your purchases.

8.4 Neither the allowance nor topped-up units are transferable to another company or exchangeable for money; this is without prejudice to your rights under Articles 16, 18 and 21.3.

8.5 Free Start package: you pay nothing; the limits and allowance are set out in the price list. You may terminate the contract for the free package at any time: the company owner uses the “Cancel company” function in the section Packages › Contract and data (https://app.plus.contact/balik/zrusenie-firmy), or you write to us at quick@plus.contact. If the company has a paid subscription, an incomplete payment or a running advertising campaign, these must first be ended or allowed to finish; if you are unsure, write to us. After cancellation, the company's campaigns are paused immediately and the owner receives an e-mail with the deletion date. For a further 30 days you can download all data (Article 21a.3) and revoke the cancellation. After that we delete the company's data, except for what remains under Article 21a.4 (in particular documents, records of recipients' unsubscribes and bounces under point 2.28 of Annex 2, and our activity log); the accounts of users who have no other company are deleted and we send you an e-mail about the deletion. We may change or discontinue the free package with at least 30 days' notice by e-mail; the notice period under Article 21.3 does not apply to it.

8.6 If a video is not produced due to an error in the service, we return to you the unit that the production reserved from the allowance or from a top-up.

8.7 A promo code gives a discount on the price of the Basic, Profi or Team package when you order a new subscription. You enter it in the order summary in the “Promo code” field and apply it with the “Apply code” button before submitting the order (Article 7.2); text that you have only typed into the field without applying it is not used for the order. The following applies to promo codes:

  • the discount is a percentage or a fixed amount of the package price for the period and applies to the first payment, to the payments during a set number of months from the first payment, or for the entire duration of the subscription; with an annual subscription, a discount for a set number of months applies to each annual payment that falls within that number of months; a fixed amount reduces each discounted payment to no less than €0; the summary shows how many payments the discount reduces;
  • the code determines for which packages and payment periods it is valid, from when and until when it can be applied, how many times it can be applied in total and whether it is for new companies only; a new company is a company that has not yet had any package in the service other than the free Start package; if the code does not apply to your order, the summary tells you why and the code is not applied;
  • in the summary before you submit the order you see the discount, the first payment after the discount, the further payments and how long the discount lasts (Article 4.2); the payment and the invoice are already after the discount;
  • at most one promo code can be applied to one subscription, and your company can apply the same code at most once; the code is used up only when the order is paid — if you do not complete the payment, you can use it again if it is still valid and not exhausted;
  • a promo code cannot be applied retroactively after payment, to a change of package or to a top-up, and it cannot be exchanged for money;
  • a discount you have already received stays with you until the end of its duration, even if the code meanwhile ceases to be valid or we withdraw it;
  • on a change to a higher package during the period (Article 11.1), the discount continues if the code also applies to the new package; otherwise you pay the full price for the new package from the change. The upgrade charge is calculated from the prices after the discount that applies to the current and the new package at the moment of the change. Before you confirm, we tell you whether the discount applies to the new package and show you the upgrade charge already with that discount (Article 11.1); you will see the exact amount on the invoice;
  • on a change to a lower package or to a different period (Article 11.2), the discount ends on the day from which the change takes effect; if you cancel the scheduled change before then, the discount continues;
  • where these terms refund a payment or its pro-rata part or calculate the price of the performance provided (for example Articles 10.4, 16.4, 16.5 and 21a.5), we start from the amount you actually paid after the discount.

After the discount ends, you pay the package price under Article 8.1. Neither the discount nor its end is a price change under Article 12.

Article 9 — Price and payment

9.1 Prices are set out in the price list in euros and you also pay in euros. For a monthly subscription we show the amount per month, for an annual subscription the amount per year, and for a top-up the amount per bundle. Discounts from promo codes are governed by Article 8.7.

9.2 VAT: the prices in the price list and in the order summary are exclusive of VAT and you pay exactly these amounts. We are established outside the European Union and are not registered for VAT in the Union.

  • If you are established in a Union Member State, we issue the invoice without VAT and you account for and pay the VAT (reverse charge, Article 196 of Council Directive 2006/112/EC). This also applies if you do not have a VAT identification number; in Slovakia you account for the tax under Section 69(3) and Section 78(3) of Act No. 222/2004 Coll. on value added tax. If you have a VAT identification number, enter it when paying; we show it on the invoice.
  • If you are established outside the Union, we issue the invoice without VAT.

We determine the country from the billing address and other details from the order and payment.

9.3 You pay for the subscription by payment card on the secure Stripe payment page; the card is saved for further subscription payments and you can change it in the Packages section. You pay for a top-up by card or by another method that the Stripe payment page offers at the time of purchase. Card details are processed by Stripe; they do not reach us. The subscription is paid in advance at the beginning of the period, the upgrade charge when changing to a higher package, and a top-up when ordering. You pay for the Enterprise package by invoice under the individual contract (Article 7.8).

9.4 We issue invoices electronically; the company owner can find them in the section Packages › Invoices. By placing an order you agree to electronic invoices.

9.5 You pay any payment other than the price of the chosen performance only if you yourself selected it before submitting the order; nothing is pre-selected.

9.6 We do not set prices for you by automated decision-making or profiling.

9.7 For advertising through Contact+ we charge a management fee under Article 15.2; it is included in the campaign price you confirm and is shown separately on the invoice. For advertising from the own ad account of a company with the Enterprise package we charge nothing extra and add nothing to the amounts you pay to Google or Meta (Article 15.4).

Article 10 — Duration, automatic renewal and cancellation of the subscription

10.1 We conclude subscriptions for an indefinite period. The subscription is paid in advance for a monthly or annual period and at the end of the period it renews automatically for a further period of the same length until you cancel it. The first period begins on the day of payment.

10.2 You may cancel the subscription at any time: the company owner with the “Cancel subscription” button in the Packages section, or by e-mail to quick@plus.contact. Cancellation is free of charge and takes effect at the end of the paid period; until then you have the package available. You can see the date on which the subscription ends in the Packages section and you may revoke the cancellation until then. We confirm a cancellation sent by e-mail with a reply. After the subscription ends, the company moves to the free package (Article 14.3).

10.3 The minimum duration of the commitment is one paid period: one month for a monthly subscription, 12 months for an annual subscription. When an annual subscription is cancelled, the pro-rata part of the price for the rest of the year is not refunded; this is without prejudice to your rights under Articles 10.4, 12.4, 12.5, 13, 16, 18, 21.2, 21.3, 21a and 26.2 and under point 2.16 of Annex 2.

10.4 Consumers only: you may terminate an annual subscription that has renewed automatically at any time by e-mail to quick@plus.contact. The subscription ends on expiry of one month from receipt of the e-mail, or earlier if you so request. We refund the pro-rata part of the price for the time after the end, calculated by days, within 14 days using the same means of payment you used. The first year of an annual subscription is not shortened by this.

Article 11 — Change of package

11.1 A change to a higher package takes effect immediately after payment of the upgrade charge. The upgrade charge is the difference between the prices of the two packages for the rest of the period, pro rata to the remaining time; it is charged to the saved card. Before you confirm, we show you the amount of the upgrade charge calculated as at that moment. We charge the amount calculated in the same way as at the moment of payment; it may differ from the amount shown by at most a few cents. If the subscription has a discount from a promo code, the upgrade charge is governed by Article 8.7. The allowance for the current month is topped up pro rata.

11.2 A change to a lower package or to a different period takes effect from the next period; until then the current package remains. Nothing is deleted: above the limit of the lower package you simply cannot add new items; existing users remain and you can add new ones only once their number falls below the limit.

11.3 Consumers only: a change to a higher package is a separate order with an obligation to pay and with the boxes under Article 7. You may withdraw from it under Article 16; we refund the upgrade charge reduced by the price under Article 16.4 and the company returns to its original package.

11.4 The subscription is changed by the company owner from their own account.

Article 12 — Price change

12.1 We may change the price of a package for the following reasons: a change in the prices of third-party services we use for the service (in particular AI, avatar videos, hosting, the payment gateway), a change in the USD/EUR exchange rate, a change in VAT or other taxes and fees, an increase in consumer prices according to the Harmonised Index of Consumer Prices (HICP) for the euro area published by Eurostat, by at most its year-on-year change, and an extension of the package with new features or higher limits.

12.2 We notify you of the new price by e-mail at least 30 days before the first payment at the new price. The notice states the original and the new price, the date from which it applies, the reason, and the option to cancel the subscription free of charge.

12.3 Until the end of the paid period you pay the original price. The new price applies from the first period that begins after the expiry of the time limit under Article 12.2.

12.4 If you do not agree with the new price, you may cancel the subscription free of charge no later than the day before the first payment at the new price; it ends at the end of the paid period.

12.5 Consumers only: we begin charging you the increased price only if you expressly agree to it in the manner stated in the notice. If you do not agree by the end of the paid period, the subscription ends with that period and the company moves to the free package; nothing is deleted.

12.6 For businesses: if you do not cancel the subscription by the effective date of the new price, the new price applies.

12.7 A reduced price applies from the next payment.

Article 13 — Change of the service

13.1 In addition to modifications that keep the service in the agreed condition, we may change it for the following reasons: a change in the prices or conditions of a third-party service on which a feature depends (for example AI, avatar videos, the Google or Meta interface), or its discontinuation, security, a change in legislation, and technical development. The change is at no additional cost to you.

13.2 We notify you by e-mail at least 30 days in advance of a change that worsens your access to or use of the service (for example a smaller allowance or a lower limit). If the change is triggered by a supplier with shorter notice or is required by security or legislation, we notify you as soon as possible. We state what is changing and from when, and your rights under Article 13.3 or 13.5.

13.3 Consumers only: if a change under Article 13.2 is not negligible, you may withdraw from the contract free of charge within 30 days of receipt of the notice or of the change, whichever is later. We refund the part of the price paid in advance for the time after withdrawal, within 14 days using the same means of payment you used. You do not have this right if we enable you to keep the service without the change and at no additional cost, and the service you keep remains free of defects.

13.4 A change in the scope of a package applies to you at the earliest from the first period that begins after the expiry of the time limit under Article 13.2; until the end of the paid period you have the original scope.

13.5 For businesses: you need not accept a change for the worse; you may cancel the subscription as of the date of the change and we refund the pro-rata part of the price paid for the time after the change. Simply write to us at quick@plus.contact.

Article 14 — Failed payment

14.1 If the payment for the next period fails, a 14-day period begins to run. During it, the payment gateway may retry the charge and you may pay by updating your card in the Packages section. We send the company owners an e-mail after the first failure and 3 days before the end of the period, unless they have switched off notification e-mails in their account; in the service they always see a prompt to update the card.

14.2 During this period you have the package available, but we credit a new allowance only after payment.

14.3 If the payment has still not succeeded by the end of the period, the subscription ends and the company moves to the free package. We do not pursue the unpaid payment for the new period from you. On moving to the free package nothing is deleted: above its limit you simply cannot add new items or users, and campaigns above the new daily limit slow down. Topped-up AI credits and videos remain yours until the end of their validity.

14.4 You may order a subscription again at any time in the Packages section.

Article 15 — Advertising in your ad account

15.1 The service prepares and launches advertising on Google and Meta. Advertising through Contact+ runs from an ad account that we keep for your company in our manager account, and you pay for it from advertising credit (Article 15.2). A company with the Enterprise package may also launch advertising in its own ad account, which it connects to the service (Article 15.4). If the service marks advertising on a particular network as “Coming soon”, Article 5.1 applies to it.

15.2 You top up advertising credit in advance by card in the Advertising section; you may enable automatic top-ups and disable them at any time. When topping up and whenever you save automatic top-ups switched on, you tick the box under Article 3. Credit can be topped up by a company with a paid package. The campaign amount you confirm is the final price including the management fee; the network receives the budget without the fee. The management fee is 15% of the spend in the network, at least €15 for each calendar month in which advertising through Contact+ ran; we charge the spend exactly as billed by Google or Meta and the fee is shown separately on the invoice. On launch, the campaign amount is reserved from your credit; after the campaign ends and is settled, the unspent part returns to your credit. Credit is a refundable deposit: it cannot be transferred or used for anything else, and on request we refund unspent credit within 30 days to the payment method it came from; credit you received as a bonus is not refunded. Advertising credit is not AI credits (Article 7).

15.3 The service compiles a campaign draft: texts, images or video, targeting, amount and duration. It launches the campaign only after a person from your company confirms the draft from their account; after the draft is changed, it must be confirmed again. The service monitors a launched campaign and shows the results that Google or Meta make available. On your instruction in the service it stops the campaign; a campaign in your own account you may also change or stop directly in Google or Meta.

15.4 A company with the Enterprise package may connect its own ad account to the service. Advertising from it is billed to the company directly by Google or Meta under their terms and the payment method in its account; it does not hold funds for such advertising with us and we collect nothing for it or for its management (Article 9.7). The relationship with Google and Meta, including their terms and advertising policies, is the company’s. By connecting the account you authorise us to create, change, stop and evaluate in it the campaigns you have confirmed in the service. We do not change other campaigns in your account. You may revoke access at any time directly in Google or Meta; campaigns already running in the account then continue to run until you stop them there.

15.5 For advertising through Contact+, a campaign spends at most the amount you confirmed. We are not liable for the amounts Google or Meta charge a company with its own account for campaigns confirmed by your company or changed directly in its account. For damage caused by an error in the service, for example if the service set a higher budget or a longer campaign duration than you confirmed, we are liable under Article 19. Advertising results are not guaranteed.

15.6 You are responsible for the content of the advertising: texts, images and videos must be truthful, you must hold the rights to them, and they must comply with the policies of Google and Meta and with the law. Political advertising is prohibited. Google or Meta may reject an advertisement or restrict your account; this is not a defect in the service (Article 18.5).

15.7 Before your first campaign you confirm the special advertising terms in the service; without their confirmation the service does not launch a campaign. The special terms supplement this Article; should they conflict with it, this Article prevails. Earlier wordings of the advertising terms that the service displayed before 15 October 2026 do not apply to a contract under these terms.

15.8 Contacts from advertising forms are stored among your company's contacts and you are their controller (Article 22.2).

Article 16 — Withdrawal from the contract (consumers only)

16.1 You may withdraw from a contract for a subscription, for a change to a higher package or for a top-up without giving any reason within 14 days of the day the contract was concluded. Details are in the information notice on withdrawal from the contract (Annex 1a); you may use the model form (Annex 1b). For a subscription and a change to a higher package you also receive them in the order confirmation (Article 7.4).

16.2 You may withdraw using the “Withdraw from the contract here” function (Article 17), by e-mail to quick@plus.contact or by letter to the address of our registered office (Article 1.1). You may use the model form but need not. The time limit is met if you send the notice no later than on the last day of the period.

16.3 You may also withdraw from only a part, for example only from the change to a higher package or from a single top-up.

16.4 If you requested that performance begin during the withdrawal period (Article 7.5) and then withdraw, you pay the price for the performance actually provided up to the day of receipt of the notice of withdrawal:

  • subscription: the pro-rata part of the price of the period by days started (10 days of a 30-day month is one third of the monthly price; for an annual subscription, the number of days relative to the number of days in the year);
  • change to a higher package: the pro-rata part of the upgrade charge by days started relative to the number of days for which you paid the upgrade charge;
  • topped-up AI credits and videos: the pro-rata part by the amount used, if you ticked the box under Article 7.5 when making the top-up.

If you did not request that performance begin, you pay nothing.

16.5 We refund all payments to you within 14 days of receipt of the notice of withdrawal using the same means of payment you used, without charges. We state the price under Article 16.4 in the confirmation. If you agree in the function or in the notice, we refund directly the amount reduced by this price; otherwise we refund all payments and bill you separately for the price under Article 16.4, payable within 14 days.

16.6 Withdrawal from a subscription also covers changes of that subscription to a higher package and top-ups paid for from the day the subscription was concluded until withdrawal, unless you tick the box in the function stating that you are keeping what you topped up with the subscription.

16.7 After withdrawal from a subscription we terminate it and the company moves to the free package; your data is not deleted. You no longer use the paid performance and do not make it available to others. You may download the content you created or uploaded in the service at any time free of charge (video files within the period under Article 5.3) in a machine-readable format (Article 21a.3 and Annex 3). Personal data is governed by Article 22.

16.8 The right of withdrawal expires once we have fully provided the service, if performance began with your express consent and declaration under Article 7.5. For a subscription this does not happen during the withdrawal period; for a top-up it happens when it is fully used up, if you ticked the box under Article 7.5 when ordering it.

16.9 If we have not provided you with the information notice on withdrawal, the time limit is extended in accordance with the law, by at most 12 months.

Article 17 — Withdrawal function (consumers only)

17.1 In the section Packages › Contract and data there is the “Withdraw from the contract here” function (https://app.plus.contact/balik/odstupenie); the company owner may submit it from their own account. The confirmation of a subscription order and of a change to a higher package also contains a withdrawal link that works without logging in throughout the withdrawal period, that is, even if you could not log in to the service or we had restricted your access (Article 21). The user who ordered a top-up may also withdraw from it, by e-mail or letter under Article 16.2.

17.2 In the function you select the contract (subscription, change to a higher package or a specific top-up) and confirm or fill in your first name and surname and an e-mail address for the confirmation; the details are pre-filled. You do not give a reason. You may choose the deduction of the price of the performance (Article 16.5) and, for a subscription, keeping what you topped up (Article 16.6).

17.3 You submit the withdrawal with the “Confirm withdrawal from the contract” button. We send you without delay, by e-mail, an acknowledgement of receipt with the content of the notice, the date and time it was sent, and the calculation of the amount we will refund.

17.4 The function does not replace the other means of withdrawal (Article 16.2). Cancelling a subscription (Article 10.2) is a different act: it ends the subscription at the end of the period and is not a withdrawal.

Article 18 — Liability for defects and complaints

18.1 We are liable for the service functioning throughout the term of the contract as described in these terms and the price list; if you are a consumer, also as can reasonably be expected of such a service.

18.2 You report a defect by e-mail to quick@plus.contact or by letter to the address of our registered office (Article 1.1). Describe what is not working and since when. We confirm receipt of the complaint without delay by e-mail. We handle the complaint and remedy the defect without undue delay; if you are a consumer, no later than 30 days from its submission. We send you an e-mail about the outcome; if we reject the complaint, we state the reasons in it.

18.3 Consumers only: you have the right to have the defect remedied free of charge. If the defect cannot be remedied, we do not remedy it in time, it recurs, it is serious or we have declared that we will not remedy it, you have the right to a reasonable discount for the time the service did not work, or you may withdraw from the contract; for a negligible defect only to a discount. For a discount we refund its amount. On withdrawal we refund the price for the time the service had the defect and the part of the price paid in advance for the time after the end of the contract. In both cases we do so within 14 days using the same means of payment you used. Until we remedy the defect, you may withhold payment of the price or part of it, provided you are not in default. The right to compensation for damage is not affected. The burden of proving that the service is free of defects during the contract lies with us; the exception is in Article 5.5.

18.4 For businesses: we remedy the defect; if that is not possible, we grant a reasonable discount for the time the service did not work. Further rights are governed by the Commercial Code (Obchodný zákonník).

18.5 It is not a defect in the service when Google or Meta rejects an advertisement or restricts your ad account, when an e-mail is not delivered because of the settings of your mailbox or the recipient's mailbox, or a limitation stated in Article 5.3.

Article 19 — Liability for damage

19.1 We are liable for damage in accordance with the law.

19.2 For businesses: we compensate actual damage and lost profit, but not damage beyond the extent we could have foreseen at the conclusion of the contract.

19.3 You are responsible for the content of the e-mails, posts and advertisements you prepare or approve and for the choice of recipients (Article 20). Liability for the amount of a campaign through Contact+ and for spending in your own ad account is governed by Article 15.5.

19.4 For businesses: if you cause us damage by breaching Article 20, in particular a fine imposed by an authority or a claim by a recipient or another third party, you will compensate us for it.

Article 20 — Your obligations when using the service

20.1 Use the service in accordance with the law and these terms. You are the sender of the e-mails and the controller of the personal data of the contacts you upload to the service. You are responsible for the legal basis for contacting recipients, the content of the e-mails and the choice of recipients, even if you are a consumer. You are likewise responsible for informing recipients about the measurement of opens and clicks (Article 5.3) and for having their consent where required.

20.2 Before your first live e-mail you fill in, in the company settings, the sender address, the sender identification in the footer, the signature and the address of your own privacy policy, and confirm the legal basis for contacting recipients; without this the service sends nothing live. We do not host the privacy policy for your recipients on your behalf: you must have it published at your own address and the service inserts a link to it into the e-mails. The service provides you with a tool and sample texts, not a legal assessment; we do not verify the truthfulness of your confirmation.

20.3 You must not:

  • send commercial communications in breach of the law;
  • circumvent the limits, unsubscribes and safeguards of the service, for example by creating additional accounts to obtain another free package;
  • upload content to which you do not hold the rights, or unlawful content;
  • use the service to create misleading, hateful, harassing or fraudulent texts and videos, or to impersonate other persons without their consent;
  • attack the security of the service or of third-party systems.

When using the artificial intelligence and avatar video features you also comply with the usage policies of their suppliers; the suppliers are listed at https://plus.contact/en/spracovatelia.

20.4 Unsubscribing one address stops further e-mails to all addresses of the same recipient organisation, as recorded in your contacts, and to its domain (except public domains, for example gmail.com) in all campaigns of your company. An undeliverable address (bounce) stops e-mails only to that address. These rules cannot be switched off.

20.5 The processing of the contacts' personal data on your behalf is governed by the Data Processing Agreement (Annex 2).

20.6 A video with a character or voice resembling a real person is content created by artificial intelligence. When you publish or send such a video, you clearly state that it was created with AI. On a social network you switch on the AI-generated content label that the network offers for the post; elsewhere you add a sentence, for example “This video was created with an AI avatar.” The service itself adds nothing to the text of the post.

20.7 You upload another person's photo or voice to the service only with their consent. You record the consent in the wizard; without it the service does not create an avatar from the photo or a voice from the recording. On request, you provide proof of the consent. If the person revokes their consent, you remove their character and voice from the service and write to us at quick@plus.contact. Characters, voices and the videos produced with them, including scripts, are not deleted automatically at the avatar video supplier when removed in the service; at your request we delete them there within 30 days, and within 30 days after deletion of the company also without a request (except characters and voices that at the time of its deletion are still used in the service by another company or by us; point 2.29 of Annex 2).

20.8 The service publishes social media posts in your accounts only after a person from your company approves their wording. You are responsible for their content and for compliance with the networks' terms.

20.9 Content you upload to or create in the service, including texts and videos prepared by artificial intelligence, is yours and we claim no rights to it. For the term of the contract and the periods under Article 21a, you grant us a free, non-exclusive right to store, reproduce and adapt this content (for example the video format for a network) and, on your instruction, to publish or send it, solely to the extent necessary to provide the service. We do not guarantee that the output of artificial intelligence is protected by copyright. The service, its software, design and sample texts are ours; during the contract you may use them within the scope of your package, the sample texts also in your own e-mails and posts.

Article 21 — Suspension and termination on our part

21.1 If you breach Article 20 or the law, if recipients complain about your e-mails, or if the confirmation of the legal basis is manifestly untrue, we may suspend sending, advertising or access until the matter is explained. If it turns out that no breach occurred, we refund the pro-rata part of the price for the time the paid service was restricted. When we restrict sending, advertising or access, remove content or cancel an account, we send you a statement of reasons by e-mail: what we restricted and for how long, the facts and provisions on which the decision is based, whether we used automated means, and how you can contest it (an objection to quick@plus.contact, which a person will assess, or a court).

21.2 In the event of a serious or repeated breach we may terminate the contract with effect from the day the notice of termination is received. We refund the part of the price paid in advance for the time after the end of the contract; this is without prejudice to our right to compensation for damage. Even after termination we allow you, on request, to download your data for 30 days (Article 21a.4).

21.3 For other reasons (for example discontinuation of the service or of a package) we may terminate the contract with a notice period of 2 months; for the free package, Article 8.5 applies. We refund the part of the price paid in advance for the time after the end of the contract and the price of unused top-ups.

21.4 We do not review in advance and do not generally monitor the content you upload to or create in the service (contacts, texts, images, videos, posts). Automatically, the service only:

  • pauses a campaign when more undeliverable messages come back from its e-mails than the set threshold allows, or when the provider of your mailbox rejects an e-mail of the campaign as suspicious, and sends an e-mail about this to the administrator address from your company's settings; you may then restart the campaign;
  • holds back sending when the provider of your mailbox restricts sending;
  • enforces the daily limits, unsubscribes and the confirmation of the legal basis (Article 20);
  • checks the network's technical requirements before a post is approved (for example text length, image or video format and size) and does not allow a post that the network would reject to be approved;
  • checks the formal requirements of a draft before advertising is launched (for example text length and images); the content of the advertising is assessed by Google or Meta.

A restriction under Articles 21.1 and 21.2 is always decided by a person from our team on the basis of notices, recipients' complaints or our own findings; we do not use automated decision-making for this.

21.5 Anyone may report unlawful content in the service to us by e-mail to quick@plus.contact; put “Illegal content” in the subject line. In the report, state why you consider the content unlawful, exactly where it is (for example the full internet address), your name and e-mail, and a statement that the information and allegations in the report are, to the best of your knowledge, accurate and complete. If you are reporting content that may relate to the sexual abuse of children, you need not give your name and e-mail. We confirm receipt of the report. A person assesses the report without undue delay and we inform you by e-mail of the decision and the possibilities of redress; we do not use automated means to assess reports.

21.6 If we become aware of information giving rise to a suspicion of a criminal offence threatening the life or safety of persons, we notify the authorities of the state concerned.

21.7 The single point of contact under Articles 11 and 12 of the DSA for the authorities of the Member States, the European Commission and the European Board for Digital Services, as well as for you and the other users of the service, is the e-mail address quick@plus.contact. You may write to the point of contact in Slovak, Czech or English; messages are answered by a person. Our legal representative under Article 13 of the DSA is stated in Article 1.2.

Article 21a — Switching to another provider and data export

21a.1 You may at any time notify us by e-mail to quick@plus.contact that you wish to switch to another provider, transfer your data to your own infrastructure or delete it. The notice period for starting the switch expires at the end of the period you paid for before the notice, but no later than 2 months from the notice; at your request we start earlier. For the free package we start without a notice period.

21a.2 The notice period is followed by a transitional period of at most 30 days. During it the contract continues and the service runs; we give you and the provider you have designated reasonable assistance with the switch, provide the necessary information, warn of known risks to the continuity of the service and maintain a high level of security. If the switch were not technically feasible within 30 days, we notify you of this with reasons within 14 working days of your notice and extend the transitional period, to at most 7 months. You may also extend the transitional period once, for a period you consider appropriate; during the extension the contract and payments continue as before. The contract ends upon a successful switch and we notify you of the end by e-mail. If you only want your data deleted, the contract ends on expiry of the notice period; the “Cancel company” function (Article 8.5) also serves for deletion without a switch.

21a.3 The company owner may download all company data at any time and free of charge in a single JSON file in the section Packages › Contract and data (https://app.plus.contact/api/export/firma). The export contains everything the company has created or uploaded in the service: contacts and lists, custom fields, templates, signatures and sequences, campaigns, sent and received e-mails, unsubscribes, posts, images and videos (as records with a link to the file), AI texts, advertising, orders, invoices and settings without secret data. The files of published and rejected videos are available in the export only until their deletion under Article 5.3. Each user may also download contacts in CSV or XLSX format in the Companies and People lists. The structure and formats of the export, the data that is not exported and the known limitations are described in Annex 3. We recommend that you download the export regularly.

21a.4 After the end of the contract (in the case of a switch, after the transitional period) you have at least 30 days to download your data. We then delete the company's data. Only the following remain:

  • documents and records that we must keep by law or for the defence of legal claims, for example orders, invoices, withdrawals, agreement to the terms and details of the ad accounts linked to the company, without login details; for how long is stated in the privacy policy (Article 22.1);
  • records of your recipients' unsubscribes and bounces, which, on your instruction in point 2.28 of Annex 2, we keep as evidence that the recipient objected and that you respected the objection; you may revoke the instruction at any time and we then delete the records within 30 days;
  • our log of actions in the service (who did what and when), which we keep for the periods set out in the privacy policy, as a rule 4 years from the entry, and in which we replace the name and e-mail of deleted accounts; at your request we delete your company's data from it under point 2.27 of Annex 2;
  • the technical log of calls to external services, which is deleted automatically after 30 days;
  • server maintenance logs, which may contain company data and which GitHub deletes after the period set in our account, no later than after 400 days (point 2.27 of Annex 2);
  • characters and voices created in the Service and the videos produced with them, including scripts, in our account at the avatar video supplier, where we delete them within 30 days after deletion of the company, except characters and voices that at the time of its deletion are still used in the Service by another company or by us (point 2.29 of Annex 2), and our record of them, which we delete once their erasure is confirmed, no later than 90 days after deletion of the company or, if because of a fault the notice to our administrators to delete them is sent later than 60 days after deletion of the company, no later than 30 days after that notice is sent (point 2.27 of Annex 2).

Deleted data disappears from the database backups on the server within 3 weeks at the latest (Article 21a.6).

21a.5 We charge no fee for the switch or the export. If, with an annual subscription, the contract ends by a switch before the end of the paid year, we refund the annual price reduced by the monthly price of the same package according to the price list in force at the time of the order for each month started until the end of the contract, if the result is a positive amount. We charge no other fees or penalties for early termination.

21a.6 We store the service's data (the database and files) on a server of the company Hostinger in a data centre in the Netherlands; this infrastructure is subject to the law of the Netherlands and of the European Union. We back up the database once a day on the same server; we make further database backups before deploying a new version, before restoring the database and during maintenance. Every backup is deleted automatically after 14 days. We do not back up files (images and videos). We do not yet store backups outside this server; if we change this, we will announce it in advance under point 2.16 of Annex 2 and amend these terms. Some features, when used, pass the necessary part of the data to suppliers, including outside the Union (for example for AI texts, avatar videos or speech transcription). Server maintenance logs, which may also contain part of the company's data, are kept by GitHub in the USA, and when evaluating them our staff are assisted by the Claude assistant of the company Anthropic (point 2.14 of Annex 2). The list of suppliers is at https://plus.contact/en/spracovatelia.

21a.7 We are a company established in the USA. Against unlawful access by authorities of states outside the Union to your non-personal data stored in the Union, and against its unlawful transfer, we have adopted the following measures:

  • the connection to the service is encrypted (HTTPS);
  • we store mailbox passwords and access tokens for networks and accounts encrypted (AES-256-GCM) and the key is not stored in the database; we store user passwords only as hashes;
  • on our side, only authorised persons log in to company data, using named accounts, and we record in the log every entry they make into a company of which they are not a member (Article 22.3);
  • we comply with a request by an authority of a state outside the Union for access to this data only to the extent permitted by Article 32 of Regulation (EU) 2023/2854 (Data Act), provide only the necessary minimum, and inform you in advance unless the law prohibits it.

Article 22 — Personal data

22.1 For the personal data of the service's users and the data needed for registration, orders, payments and invoicing, support and security, we are the controller. How we process it is described in the Contact+ Privacy Policy at https://plus.contact/en/ochrana-udajov; information on cookies is at https://plus.contact/en/cookies.

22.2 For personal data that your company uploads to or obtains in the service (contacts and recipients, their replies, contacts from advertising forms, people in videos), your company is the controller and we are its processor. The processing is governed by the Data Processing Agreement in Annex 2, which you conclude by accepting these terms. The list of further processors is at https://plus.contact/en/spracovatelia.

22.3 On our side, only authorised persons access company data, exclusively through named accounts, when necessary for operation and support, for handling your request, for security or for monitoring compliance with these terms and the law. We record in the log every entry they make into a company of which they are not a member, with their name, the time and the company code; we send you an extract on request.

22.4 Our representative in the Union under Article 27 of the GDPR is stated in Article 1.2.

Article 23 — Request for redress and dispute resolution (consumers only)

23.1 If you are not satisfied with how your complaint was handled or you believe we have infringed your rights, you may ask us for redress by e-mail to quick@plus.contact. We deal with the request within 30 days.

23.2 We are established outside the European Union. The rules of the Union Member States on alternative resolution of consumer disputes apply to traders established in the Union, and we therefore do not undertake to participate in alternative dispute resolution. If we do not resolve a dispute by agreement, you may go to court (Article 24) or lodge a complaint with the consumer protection supervisory authority in your state; in Slovakia, the Slovak Trade Inspection (Slovenská obchodná inšpekcia).

Article 24 — Governing law and courts

24.1 The contract is governed by the law of the Slovak Republic.

24.2 Consumers only: if you are habitually resident in another state, the choice of law does not deprive you of the protection afforded by the provisions of the law of that state that cannot be derogated from by agreement (Article 6 of Regulation (EC) No 593/2008, Rome I). You may also sue us in the courts of the state of your domicile; we may sue you only there.

24.3 For businesses: disputes are decided exclusively by the courts of the Slovak Republic.

Article 25 — Communication and service of notices

25.1 We communicate in Slovak, Czech and English; we send contractual documents, confirmations and notices in Slovak.

25.2 We send notices under these terms by e-mail to the company owner's address in the service; keep it up to date. Company owners also receive subscription payment alerts in the service.

25.3 You write to us at quick@plus.contact, call us at +421 910 468 787 or write by letter to the address of our registered office (Article 1.1); you may also send a withdrawal using the function under Article 17. The point of contact under the DSA is stated in Article 21.7.

Article 26 — Changes to the terms

26.1 We may change the terms for the reasons under Articles 12.1 and 13.1 or because of a change in legislation. We announce a new version by e-mail to company owners at least 30 days before it takes effect and publish it at https://plus.contact/en/podmienky; if legislation requires the change sooner, we announce it as soon as possible. A change that is only to your advantage or only corrects an obvious error in the text may be made without this notice period; we announce it by publishing the new version. On request, we will e-mail you the wording that applied previously.

26.2 If you do not agree with the change, you may cancel the subscription free of charge as of the effective date of the change; write to us at quick@plus.contact and we refund the part of the price paid for the time after that day. You terminate the contract for the free package by cancelling the company (Article 8.5).

26.3 Consumers only: a change to the price, the cancellation conditions or other information you received before the conclusion of the contract applies to you only with your express agreement (Article 12.5); without your agreement the existing wording continues to apply to you. Changes to the service, its features and limits are governed by Article 13.

26.4 A change does not affect top-ups already paid for to your detriment.

Article 27 — Final provisions

27.1 These terms, version 2026-11-05, are effective from 5 November 2026. The version effective at the time of its conclusion applies to the contract, unless it has been changed under Article 26.

27.2 If any provision is invalid, the others remain in force.

27.3 The annexes form part of the terms: 1a — information notice on withdrawal from the contract; 1b — model withdrawal form; 2 — Data Processing Agreement; 3 — export formats. Prices and the content of packages are determined by the price list.

27.4 For businesses: your terms and conditions do not apply to the contract unless we expressly accept them in writing.

Annex 1a — Information notice (Annex No. 3 to Act No. 108/2024 Coll. on Consumer Protection, in Slovak zákon č. 108/2024 Z. z. o ochrane spotrebiteľa, completed for Contact+)

INFORMATION ON THE EXERCISE OF THE CONSUMER'S RIGHT OF WITHDRAWAL FROM A DISTANCE CONTRACT AND A CONTRACT CONCLUDED AWAY FROM THE TRADER'S BUSINESS PREMISES

1. Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, inform us of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an e-mail) at: RESINOS & GO UP SYSTEMS INC., 228 Park Ave S #86399, New York, NY 10003, USA, telephone +421 910 468 787, e-mail quick@plus.contact. For this purpose you may use the model withdrawal form that we have handed or sent to you, but its use is not obligatory.

You may also exercise the right of withdrawal online at https://app.plus.contact/balik/odstupenie (in Contact+: Packages › Contract and data › Withdraw from the contract here) and, for a subscription and a change to a higher package, also via the link in the order confirmation e-mail, which works without logging in. If you use this option, we will provide you without delay, on a durable medium (for example by e-mail), with an acknowledgement of receipt of the withdrawal, including its content and the date and time it was sent.

The withdrawal period is met if you send the notice of the exercise of the right of withdrawal before the withdrawal period expires.

2. Effects of withdrawal

If you withdraw from this contract, we will reimburse to you all payments you have made in connection with the conclusion of the contract, including the costs of delivery of goods to you. This does not apply to supplementary costs if you chose a type of delivery other than the least expensive type of standard delivery offered by us. Payments will be reimbursed no later than 14 days from the day on which we receive your notice of withdrawal from this contract. Reimbursement will be made using the same means of payment as you used for your payment, unless you have expressly agreed to a different means of reimbursement, and without any additional charges.

If you requested that the provision of the service begin during the withdrawal period, you are obliged to pay us the price for the performance actually provided up to the day on which you notified us of your decision to withdraw from this contract.

Annex 2 — Data Processing Agreement

This English version is a translation; the Slovak version is binding.

2.1 Parties and conclusion. This data processing agreement (hereinafter the "Processing Agreement") is an agreement under Article 28(3) of Regulation (EU) 2016/679 (hereinafter the "GDPR"). You conclude it as the controller of the personal data that the Service processes in your company, and we, RESINOS & GO UP SYSTEMS INC., 228 Park Ave S #86399, New York, NY 10003, USA, EIN 981914999, NYBE ID 265604920, conclude it as the processor. It forms part of the Terms and Conditions as their Annex 2. You conclude it by agreeing to the Terms and Conditions, including this agreement, which you confirm at registration or when creating a further company, and it applies to every company that you manage in the Service. The electronic form satisfies the requirement of written form (Article 28(9) GDPR). If you process company data as a processor for another controller (for example as an agency for a client), the provisions on the controller apply to you accordingly: we are your sub-processor and you are responsible for ensuring that your instructions comply with the instructions of your controller. The clauses of this Annex are numbered 2.1 to 2.32; a reference to a clause means a clause of this Annex, and a reference to an article means an article of the Terms and Conditions.

2.2 Contact and representative in the Union. In matters concerning this agreement, write to us at quick@plus.contact or call +421 910 468 787. Our representative in the Union under Article 27 GDPR is ERIOS, s.r.o., IČO 29789770, Rybná 716/24, Staré Město, 110 00 Praha 1, Czech Republic; documents for it may also be sent to quick@plus.contact. We send notices under this agreement by e-mail to the owners of your company at the addresses of their accounts in the Service.

2.3 Data covered by this agreement. This agreement covers the personal data that you upload to or enter into the Service, and the data that the Service obtains on your instruction, in particular from your e-mail mailbox, from the forms of your advertisements and from people in your videos (hereinafter "company data"). It does not cover data whose purposes and means we determine ourselves, for example user accounts, registration, orders and payments, security records and communication with us. Those are described in the Privacy Policy at https://plus.contact/en/ochrana-udajov.

2.4 Precedence. In matters of processing company data, the Processing Agreement takes precedence over the other provisions of the Terms and Conditions. The standard contractual clauses under clause 2.18, to the extent they apply, take precedence even over this agreement.

2.5 Duration. The Processing Agreement lasts as long as the Service Agreement for the given company lasts, and thereafter until we delete the company data in accordance with clauses 2.26 to 2.29.

2.6 Nature and purpose of processing. We process company data only in order to provide the Service to you, and only to the extent of the features that you use in the company. The purpose is your business communication and marketing. The processing operations are:

  • storage and management of contacts of companies and persons, lists and the stop-list, import from files and manual entry;
  • composing and sending e-mails and e-mail sequences from your e-mail mailbox (SMTP), including the unsubscribe link, and creating e-mail signatures;
  • processing replies: reading your connected mailbox (IMAP), assigning a reply to a contact and campaign, recognising unsubscribes and undeliverable addresses, and notifying the administrator of your company;
  • measuring opens and clicks in sent e-mails (clause 2.10);
  • recording unsubscribes and bounces and stopping further e-mails in accordance with the Terms and Conditions;
  • drafting texts with artificial intelligence (e-mails, posts, advertisements, video scripts) and, on your instruction, drafting a reply from the text of a received message;
  • creating characters and voices from a photo and a recording of a person, producing videos with them and transcribing speech in videos;
  • publishing posts on your pages and accounts on social networks;
  • advertising on Google and Meta: preparing a campaign, launching it through Contact+ from the ad account we keep for your company or, with the Enterprise package, in your own advertising account that you connect to the Service, only after confirmation by a person from your company, and displaying its results;
  • collecting contacts from the forms of your advertisements on Meta;
  • voice control of the Service by your users;
  • backup, export and deletion of data.

2.7 Data subjects.

  • recipients of e-mails and other persons in your contacts, in particular contact persons of companies, sole traders and other persons whose data you upload to, enter into or obtain through the Service;
  • persons who write to you at the mailbox connected to the Service, in particular recipients who reply to your e-mails;
  • persons who fill in the form of your advertisement on Meta;
  • persons whose photo, voice or likeness is in the Service (characters, voices and videos), and other persons who appear in the content of your e-mails, posts, advertisements and videos;
  • your users and colleagues, namely in e-mail signatures, when approving campaigns and videos, and when using voice control.

2.8 Categories of personal data.

  • contacts of companies and persons: name and legal name of the company, company registration number (IČO), address, district, region, postcode, website, telephone numbers and other company data that you upload to the Service; name, position, company, city, languages, telephone numbers and web addresses of a person;
  • e-mail addresses: the address, its origin (public portal, company website, derived address, manual entry, import or Meta advertisement form), the address of the page where the address was found, a personal-address flag and status (for example being contacted, replied, unsubscribed, undeliverable, excluded);
  • custom fields: any text of up to 1,000 characters under a name that you define;
  • lists and campaigns: inclusion in lists and campaigns and a copy of the recipient's data at the time of inclusion;
  • sent e-mails: address, subject, sequence step and time of sending; for a standalone e-mail also the full body, the delivery error and data on opens and clicks under clause 2.10;
  • received messages: address and name of the sender, subject, text of the reply without the quoted previous message (at most 8,000 characters), time, assignment to a campaign and contact, and the identifier of the processed message;
  • unsubscribes and bounces: address, unsubscribed domain or organisation of the recipient, reason, source, campaign and time;
  • contacts from Meta advertisement forms: name, e-mail, telephone, other answers in the form and the identifiers of the page, form and advertisement;
  • characters, voices and videos: face photo, voice recording and voice clone, generated videos, name, job title and other profile data in the video, pronunciation of words and the text of the person's consent;
  • content: texts, images and videos of e-mails, posts and advertisements, if they contain personal data;
  • data of your people: name, job title, contact details and photo in e-mail signatures; name, decision and note when approving; e-mail of the person responsible for a campaign; transcripts of voice commands.

2.9 Data that does not belong in the Service. Do not upload to the Service special categories of personal data (Article 9 GDPR, for example data on health, religion or political opinions), data relating to criminal offences (Article 10 GDPR) or data of children. Custom fields of contacts are free text and the Service does not check their content; you are responsible for what you enter into them.

2.10 Measuring opens and clicks. Into every campaign e-mail and into standalone e-mails, the Service inserts an invisible image, and links in the body of the e-mail are routed through a redirect at https://link.plus.contact. Only the unsubscribe link and links whose text shows the address itself lead directly, without redirection; links in the signature and in the footer added by the Service are left unchanged by the Service. To links in the body, other than the unsubscribe link, it adds a source and campaign label (UTM parameters), by which the target page can see that the visitor came from an e-mail. Both the image and the redirected links carry a random code that connects them to a specific e-mail, and thereby to its recipient. For each e-mail, the Service records the time of the first and last open and their number, the time of the first click, the number of clicks and the last clicked address. It shows these data to your users, and on their basis recipients can be selected for a further campaign or excluded from it. The Service does not record the IP address, device data or cookies in the process. A reply that you send from Mail in the Service to a received message contains neither the image nor redirected links. In campaign e-mails and in standalone e-mails, measurement currently cannot be switched off.

Please note that, according to Guidelines 2/2023 of the European Data Protection Board on the technical scope of Article 5(3) of Directive 2002/58/EC, this provision (in Slovakia, Section 109(8) of Act No. 452/2021 Coll. on Electronic Communications (zákon č. 452/2021 Z. z. o elektronických komunikáciách)) also applies to such measurement, and it may therefore require the prior consent of the recipient. Whether you need consent and how you inform recipients about the measurement is for you to assess as the controller and sender.

2.11 Instructions. We process company data only on your documented instructions, including with regard to transfers to a third country. The instructions are:

  • the Terms and Conditions, including this agreement;
  • the settings of your company in the Service;
  • the actions that you or your users take in the Service, for example importing contacts, adding to a list or campaign, approving and launching a campaign, connecting a mailbox or account, creating a character or video, and confirming an advertisement;
  • other written instructions of the company owner sent by e-mail to quick@plus.contact, if the Service allows them or if we agree on them.

If, in our opinion, an instruction infringes the GDPR or another data protection provision, we will inform you without delay and we need not carry it out until the matter is clarified. If other processing is required of us by Union or Member State law to which we are subject, we will inform you of that in advance, unless that law prohibits it.

2.12 What we do not do with company data. We do not use company data for purposes other than those stated in this agreement (clauses 2.6, 2.13 and 2.27); in particular, we do not use it for our own marketing, we do not sell it, we do not make it available to other customers or other companies in the Service, and we do not use it to train artificial intelligence models. Each company in the Service has its own contacts; your contacts and the unsubscribes in your company are not used in another company.

2.13 Confidentiality and access by our people. Only those of our people who need access for the operation of the Service, support and security have access to company data. They are bound in writing by confidentiality, which continues after the end of their cooperation with us. They enter your company in the Service only with their own named accounts, never with a shared password, and only when necessary for support that you request, for resolving an error or a security incident, for verifying compliance with the Terms and Conditions, or when required by law. Every entry they make into a company of which they are not members is recorded by the Service in the log with their name, the time and the company code; we will send you an extract on request. When administering the server, they may also see company data in maintenance outputs (clause 2.14).

2.14 Technical and organisational measures. To protect company data, we use the following measures:

  • encrypted transmission: communication with the Service is encrypted (HTTPS) with Let's Encrypt certificates, and the Service instructs the browser to use HTTPS only (HSTS);
  • location: the database of the Service and the files of companies are on our server in the data centre of Hostinger in the Netherlands;
  • passwords: we store them only as a hash created with the scrypt function with a salt; a password has at least 12 characters and we never store or display it anywhere in readable form;
  • sign-in: tokens for sessions, invitations, password reset and registration are held in the database only as hashes; a session is valid for at most 30 days and signing out invalidates it on the server as well; we limit the number of sign-in attempts both by IP address and by account; the Service does not yet offer two-factor sign-in;
  • encryption of secrets: passwords to e-mail mailboxes and access tokens and keys to social networks, advertising accounts and the services of sub-processors are encrypted in the database (AES-256-GCM) with a key that is not in the database; the export does not include them;
  • separation of companies: every record of company data in the database carries the company label (except operational records under clause 2.27) and the database does not allow a record of one company to be linked to a record of another company; a user works only in companies of which they are a member, and the database verifies this during the session; our people enter companies in accordance with clause 2.13;
  • named accounts and roles: every user has their own account and role in the company;
  • log: approvals, campaigns, connections, changes to accounts and access, deletions, advertising, plans and entries of our people into companies under clause 2.13 are recorded in the log with name and time, as are changes to settings;
  • safeguards against erroneous sending: the database ensures that the same campaign step is sent to the same address at most once; an unsubscribe stops further e-mails in accordance with the Terms and Conditions, and a campaign is not launched live until you confirm the legal basis for contacting;
  • mailbox without interference: the Service reads messages from the connected mailbox and does not delete or move them; it marks as read only the non-delivery notices for its own e-mails that it has itself processed;
  • measurement without device data: for opens and clicks, the Service does not record the IP address, device data or cookies, only the data under clause 2.10;
  • public files: images and videos stored in the Service, including photos of characters, are accessible without signing in only at an address with a random, unguessable name, because e-mail programs, social networks and the avatar service must be able to download them; the recording for a voice clone is accessible in this way only until the voice is created, at most one day;
  • consent of people in videos: without the text of the person's consent being recorded, the Service does not create a character from a photo or a voice from a recording;
  • minimisation: some files and records that are no longer needed are deleted by the Service itself within the periods under clause 2.25, and the technical log of calls to external services after 30 days (clause 2.27); it does not store the audio of voice commands and does not record the content of calls during voice control;
  • errors and server logs: we record application errors without e-mail addresses and tokens and delete them 30 days after the last occurrence; container logs are continuously overwritten; server maintenance outputs, which may contain for example campaign names or e-mail addresses, are stored with GitHub, which deletes them after the period set in our account, at the latest after 400 days, and when evaluating them our people are assisted by the Claude assistant of Anthropic; both are in the list of sub-processors (clause 2.15);
  • backups: we back up the database once a day on the same server, and we make further backups of the database before deploying a new version, before restoring the database and during maintenance; every backup is deleted automatically after 14 days; the files of companies are not yet backed up; off-server backup is not yet switched on, and if we switch it on we will give notice in accordance with clause 2.16 and at the same time adjust the periods in clause 2.27;
  • verification of changes: changes to the core of the Service are verified by automated tests, including tests of the safeguards in the database.

2.15 Sub-processors. You grant us general written authorisation to engage sub-processors. Their current list, with the place of processing, activity, data and the safeguard for transfers, is at https://plus.contact/en/spracovatelia and forms part of this agreement. Some of them we use always (for example hosting and system mail), others only when you use a feature in the company that needs them, for example AI drafts, avatar videos or voice control. We hand over company data to a sub-processor only on the basis of a written processing agreement (usually its standard one) that imposes on it the obligations under Article 28(4) GDPR, in particular to process data only on our instruction and not for its own purposes, to keep it confidential, to secure it, to assist with the rights of data subjects and in the event of a personal data breach, and to delete or return it after the end of processing. We are liable to you for the performance of its obligations as for our own.

Sub-processors do not include providers with whom you have your own contract and to whom you give us access by connecting your account or mailbox: Google for Google Ads and YouTube, Meta, LinkedIn and your e-mail provider. Their position in relation to you is determined by your contract with them and their terms: the provider of your e-mail mailbox is usually your processor, while Google, Meta and LinkedIn are, under their terms, independent controllers for most processing. In their services, we act only on your instruction. Nor is the maker of your browser a sub-processor when the browser itself recognises speech during dictation and voice control. Google is our sub-processor only in the roles stated in the list (our mail, including system e-mails, and editing of character photos).

2.16 Change of sub-processors and objection. We will notify the addition or replacement of a sub-processor by e-mail to company owners at least 30 days before we begin handing over company data to it. Until that day, you may object to the change on reasoned grounds by e-mail to quick@plus.contact. We may accommodate the objection, for example, by not using the new sub-processor for your company. If we do not accommodate it, you may terminate the Service Agreement free of charge with effect no later than the date of the change; we will refund the part of the price paid in advance for the period after the end of the agreement.

2.17 Transfers outside the European Economic Area. We are based in the USA; however, we operate the Service on a server in a data centre in the Netherlands, where the database of the Service with its backups and the files of companies are also located. Company data leaves the European Economic Area (EEA) when it is processed by a sub-processor established or processing in a third country (clause 2.15), and to the extent that making it available to us as a US company already constitutes a transfer. A transfer to a recipient certified under the EU-US Data Privacy Framework relies on Commission Implementing Decision (EU) 2023/1795. Otherwise, to the extent they apply (clause 2.4), transfers are covered by the standard contractual clauses under Commission Implementing Decision (EU) 2021/914: between you and us, Module 2 (controller to processor) in accordance with clause 2.18, and for a sub-processor, the safeguards under Article 46 GDPR in its processing agreement, usually the standard contractual clauses. Which safeguard each sub-processor has is stated in the list under clause 2.15. If the clauses between you and us do not apply, for example because our processing of company data is directly subject to the GDPR, company data is protected directly by the obligations under the GDPR and by this agreement. On request, we will provide you with the information you need to assess the impact of the transfer.

2.18 Standard contractual clauses between you and us. The Module 2 clauses are incorporated into this agreement by reference, and by accepting the Terms and Conditions you conclude them as the data exporter and we as the data importer. Their official text is at https://eur-lex.europa.eu/eli/dec_impl/2021/914/oj. If you process company data as a processor for another controller, Module 3 applies instead of Module 2. The following applies to the clauses:

  • Clause 7 (docking clause) does not apply;
  • in Clause 9(a), Option 2, general authorisation, applies, with a period of 30 days in accordance with clause 2.16;
  • the optional sentence of Clause 11(a) on an independent dispute resolution body does not apply;
  • the competent supervisory authority under Clause 13 is the supervisory authority of the EU Member State in which you are established, in Slovakia the Office for Personal Data Protection of the Slovak Republic (Úrad na ochranu osobných údajov Slovenskej republiky); if you are not established in the Union, it is determined in accordance with Clause 13;
  • under Clause 17 (Option 2), the clauses are governed by the law of the EU Member State in which you are established; if that law does not allow for third-party beneficiary rights or if you are not established in the Union, they are governed by the law of the Slovak Republic;
  • disputes arising from the clauses are resolved, under Clause 18, by the courts of the State whose law governs the clauses;
  • the annexes to the clauses are completed by this agreement: the list of parties (Annex I.A) by clauses 2.1 and 2.2 together with the data of your company in the Service, where the signature and date are replaced by your agreement to the Terms and Conditions, which the Service stores with the time, version and hash of the terms; the description of the transfer (Annex I.B) by clauses 2.6 to 2.10 and 2.25 to 2.29, where the transfer is continuous, special categories of data are deliberately not transferred (they may incidentally appear, for example, in the text of a received reply), and the subject matter, nature and duration of the transfer to sub-processors are stated in the list under clause 2.15; the competent supervisory authority (Annex I.C) by the fourth bullet point of this clause; technical and organisational measures (Annex II) by clause 2.14; sub-processors (Annex III) by the list under clause 2.15.

An audit under Clause 8.9 takes place following the procedure under clause 2.24, unless the clauses provide otherwise.

2.19 Requests from public authorities. If a public authority, in particular of a third country, requests us to provide access to company data, we will notify you without delay, unless the law prohibits us from doing so. We will review whether the request is lawful and, if there are grounds to do so, we will challenge it. We will provide only the minimum amount of data that the request strictly requires. Details are governed by Clause 15 of the standard contractual clauses.

2.20 Rights of data subjects. We assist you in handling requests of data subjects under Articles 15 to 22 GDPR as follows:

  • you can find and display a person's data in the Companies and People lists;
  • you can export contacts in CSV or XLSX format from the Companies and People lists, and all company data in JSON format at https://app.plus.contact/api/export/firma (company owner only);
  • every campaign e-mail contains an unsubscribe link; an unsubscribe stops further e-mails in accordance with the Terms and Conditions and is recorded as an objection;
  • you can exclude a person or an entire company from your contacts from being contacted, which also stops running campaigns;
  • the Service does not yet have rectification and erasure of an individual person's data as a standalone feature; we will carry them out at your request sent to quick@plus.contact without undue delay, at the latest within 14 days, so that you can meet the one-month period under Article 12(3) GDPR. When we erase a person, we always keep every address of theirs that we erase in your company's records of unsubscribes under clause 2.28, so that the Service sends them nothing more from your company, even if you import them again; the record concerns only the address, not the recipient's organisation or domain, and unless the person had previously unsubscribed themselves, its source is the erasure. The erasure searches for records linked to the person's e-mail addresses and also for their address in the text of records of processing of received mail, notes on campaign sending runs, text suggestions by artificial intelligence and campaign test e-mails, where it replaces it. It does not find the person's name written without their address, for example a salutation in a text suggestion by artificial intelligence or the subject of a campaign test e-mail, nor the person's name or address in the free text of other records, for example in e-mails to other recipients, and these remain in such text. You can remove a person's name or address that you yourselves wrote into texts that you edit in the Service, for example into templates, by editing the text; campaign test e-mails disappear when you delete the campaign, which the Service allows for a campaign that is not running and from which no e-mail has been sent live. Erased data disappears from backups, from the technical log of calls and from server maintenance outputs within the periods under clause 2.27; we will remove the person's address from the activity log, and we will delete their character, voice and videos at the avatar service in accordance with clause 2.29;
  • you can delete all company data by deleting the company (clause 2.26).

2.21 Requests received by us. If a data subject contacts us with a request concerning the data of your company, we will forward it to the company owners without undue delay and inform the person that we have forwarded it to the controller. We will reply on the substance only if you ask us to. An unsubscribe that a person requests via the link in an e-mail is recorded by the Service itself.

2.22 Security and impact assessment. We will help you fulfil the obligations under Articles 32 to 36 GDPR. On request, we will provide you with information about the Service and about the measures under clause 2.14 that you need for a data protection impact assessment or for prior consultation with the supervisory authority.

2.23 Personal data breach. We will notify a breach of the protection of company data by e-mail to the company owners without undue delay, at the latest within 48 hours of the moment we became aware of it. We will state the nature of the breach, the categories and approximate number of data subjects and records concerned, the likely consequences, the measures we have taken or propose, and a contact. What we do not yet know, we will supplement gradually without undue delay. Notification to the supervisory authority within 72 hours and to the data subjects is your obligation as the controller; we will help you with it.

2.24 Information and audit. To demonstrate compliance with this agreement, we will first provide you with written information, in particular this agreement, a description of the measures, the list of sub-processors and answers to your reasonable questions, usually within 30 days. If that is not sufficient, you may once per calendar year conduct an audit, including an inspection, yourself or through an auditor who is bound by confidentiality and is not our competitor. The inspection takes place remotely (demonstration of settings, records and procedures) or at the place from which our people operate the Service; we have no physical access to the Hostinger data centre and we will document its security with documents of Hostinger. You will give notice of the inspection at least 30 days in advance; it will take place during working hours, without access to the data of other customers and without endangering the security of the Service, and you bear its costs. The limitation to once a year and the 30-day period do not apply if the inspection is ordered by a supervisory authority or if it concerns a breach of the protection of your company's data.

2.25 Retention during the term of the agreement. While the agreement lasts, we retain company data until you delete it where the Service allows, until we delete it at your request (clause 2.20), or until the company is deleted. The Service does not itself delete contacts, campaign records, sent e-mails including data on opens and clicks, or received replies; unsubscribing and exclusion are a status of the contact, not its erasure. The Service automatically deletes:

  • the temporary import file immediately after the import is completed; the file of an unfinished import, once it is older than 2 hours, at the next upload of a file to the Service;
  • the recording for a voice clone after the voice is created, at the latest after one day, and an unfinished character after one day;
  • media to which nothing refers, after 24 hours;
  • the files of published and rejected videos after 30 days; a reduced-size preview of the video remains until the company is deleted;
  • transcripts of voice commands after 30 days;
  • notifications in the Service (the bell), for example about a finished video or a published post, after 90 days.

2.26 End of the agreement and deletion. The Service Agreement for a company ends in particular by deletion of the company, which the company owner notifies in the section Plans › Agreement and data › Delete company (https://app.plus.contact/balik/zrusenie-firmy). If the company has a paid subscription, an incomplete payment or a running advertisement, these must first be ended or allowed to expire (Article 8.5). Campaigns are paused, and from the notification you have 30 days to download the data by export in accordance with clause 2.20 and to withdraw the deletion. After that, we will delete the company data, in particular contacts, lists, campaigns and sent e-mails, received messages, media and videos, settings and connections, and we will send you an e-mail about the deletion. We will also delete the accounts of users who are not members of another company. In this way we carry out your choice under Article 28(3)(g) GDPR: you first download the data and then we delete it. If the agreement ends otherwise, for example by termination notice, we will notify you by e-mail and delete the company data in the same way after at least 30 days for downloading it have elapsed (Article 21a.4).

2.27 What remains after deletion. Deletion does not apply to:

  • documents that we retain under the law or for the defence of legal claims, in particular orders, confirmations, invoices, withdrawals, the agreement to the Terms and Conditions at the creation of the company, and data on advertising accounts connected with the company, without access credentials; we process these as the controller in accordance with the Privacy Policy;
  • records of unsubscribes and bounces in accordance with clause 2.28;
  • the record of the company's characters, voices and videos in our account at the avatar service that we are to delete there under clause 2.29: the company's code and name, the type of object, its identifier at the avatar service and the date of deletion of the company. We keep the record as the controller solely in order to delete them there and to be able to demonstrate it, and we delete it once their erasure is confirmed, no later than 90 days after deletion of the company or, if because of a fault the notice to our administrators to delete them is sent later than 60 days after deletion of the company, no later than 30 days after that notice is sent;
  • database backups on the server (clause 2.14): every backup is deleted automatically after 14 days, so erased data disappears from the backups at the latest within 3 weeks;
  • the technical log of calls to external services (sub-processors as well as Google, Meta and LinkedIn), which is not kept per company and may contain the initial parts of requests and responses with company data (without access keys); the Service deletes it itself after 30 days;
  • server maintenance outputs (clause 2.14), which GitHub deletes after the period set in our account, at the latest after 400 days;
  • the activity log, which is not kept per company: in the entries of deleted accounts, their name and e-mail are replaced, but the description of the actions remains and may contain, for example, a campaign name or a contact's address. We retain log entries for the periods under the Privacy Policy, usually 4 years from the entry, and if a dispute or proceedings are pending at that time, until they are concluded. At your request, we will delete from it earlier, within 30 days, the data that we are able to assign to your company on the basis of the company name or the data stated in the request.

We keep the technical log, maintenance outputs and the activity log as the controller for the security of the Service, the resolution of errors and the demonstration of actions carried out in the Service in accordance with the Privacy Policy; we do not use the company data in them for other purposes.

2.28 Records of unsubscribes after the end of the agreement. By accepting the Terms and Conditions, you instruct us to continue retaining, after the other company data has been deleted, the records of unsubscribes and bounces of your recipients, including the addresses of persons erased under clause 2.20: the unsubscribed or undeliverable address, or the unsubscribed domain, the reason, the source (the way in which the unsubscribe or bounce arrived) and the time. The unsubscribe of the recipient's entire organisation and the information about the campaign from which the unsubscribe came are deleted together with the other company data. To this extent, the Processing Agreement continues after the end of the Service Agreement, and retention is the only processing that we continue to carry out for you; deletion under Article 28(3)(g) GDPR takes place when you withdraw the instruction. The purpose is to keep evidence that the recipient raised an objection or that you had their data erased, and that you respected it, for example in the event of their complaint or an inspection by the supervisory authority. We do not use the records for anything else and we do not use them in another company, not even in a new company of the same customer. The Service does not delete them itself; how long you need them is for you to assess. We will provide them to you on request sent by e-mail, and if you withdraw the instruction, we will delete them within 30 days.

2.29 Data held by sub-processors. Characters and voices created in the Service and videos produced with them, including scripts, are also stored in our account at the avatar service stated in the list of sub-processors. The Service does not delete them there itself, even when you remove them in the Service. At your request sent by e-mail, for example when a person withdraws consent, we will delete them there within 30 days. After the deletion of the company (clause 2.26), we will delete them there within 30 days even without a request and for their deletion we keep the record under clause 2.27; until we confirm their erasure, but for no longer than until that record is deleted, we will not assign them to another company in the Service. Characters and voices that the company did not create in the Service but received from our account at the avatar service are not deleted there after the deletion of the company. Nor do we delete there, after the deletion of the company, characters and voices created by the company that at the time of its deletion are still used in the Service by another company or by us (for example as the default character or voice in the Service settings). Other sub-processors retain data in accordance with their processing agreements.

2.30 Your obligations as the controller. You are responsible in particular for ensuring that:

  • you have a legal basis for processing company data, you obtained the contacts lawfully, and your outreach complies with the rules on electronic communications;
  • you have provided data subjects with the information under Articles 13 and 14 GDPR, including information about the measurement of opens and clicks (clause 2.10); before the first live e-mail, you must enter the address of your privacy policy in the Service;
  • you have the consent of the persons whose photo or voice you upload to the Service, and you record it in the Service;
  • for contacts from the forms of your advertisements on Meta, you record the legal basis in the Service, otherwise the Service will not send them an e-mail;
  • you do not upload to the Service the data under clause 2.9;
  • your instructions comply with the law and you keep your own records of processing activities;
  • your users use the Service in accordance with this agreement.

2.31 Liability. Each party is liable for damage caused by a breach of this agreement in accordance with the provisions of the Terms and Conditions on liability for damage. These provisions do not limit liability towards data subjects under Article 82 GDPR or liability under Clause 12 of the standard contractual clauses, if they apply. If one party compensates a data subject for damage for which the other party is also liable, it is entitled to claim back from the other party that part of the compensation corresponding to the other party's share of responsibility for the damage (Article 82(5) GDPR). We are liable to you for sub-processors as for ourselves. You are responsible for the lawfulness of the instructions and for the obligations under clause 2.30.

2.32 Amendments to the agreement. We may amend this agreement by the same procedure as the Terms and Conditions (Article 26), that is, with advance notice. We notify changes of sub-processors in accordance with clause 2.16.

Annex 3 — Export formats

This Annex describes the formats in which you download your data from the service (Article 21a.3), what the export contains and what it does not. Sections and fields of the export may be added as the service develops; adding a section or field is not a change to the terms under Article 26 and we will supplement the description in this Annex. We announce the removal of a section or a change of format under Article 26.

1. Export of all company data (JSON)

Who and where: the company owner from their own account in the section Packages › Contract and data via the “Download all company data” link, at any time and free of charge. It is a GET request to https://app.plus.contact/api/export/firma in a logged-in session. We record in our activity log who downloaded the export.

File: a single JSON file in UTF-8 encoding named contact-plus-CODE-YYYY-MM-DD.json, where CODE is the company's code in the service and YYYY-MM-DD is the export date.

Structure: the file is a single object with the following keys (the key names are in Slovak):

  • format — always “contact-plus/export-firmy”;
  • verzia (version) — the format version number, currently 1;
  • vytvorene (created) — the time the export was created in ISO 8601 format (UTC);
  • firma (company) — kod (code), nazov (name) and vytvorena (the time the company was created);
  • poznamka (note) — a short description of the export;
  • pocty (counts) — the number of records in each section;
  • sekcie (sections) — the sections with data; each section is a list of records (JSON objects) whose keys are the column names in the service's database; times are in ISO 8601 format and the records of different sections are linked by identifiers (for example kampan_id).

Sections (keys within sekcie):

  • contacts and lists: firmy_kontaktov, osoby, adresy, vlastne_polia, hodnoty_vlastnych_poli, zoznamy, clenovia_zoznamov, ulozene_pohlady;
  • templates, signatures and sequences: priecinky_sablon, stitky_sablon, sablony, stitky_na_sablonach, podpisy, kampane, kroky_kampani, vylucenia_kampani;
  • records of campaigns, mail and unsubscribes: prijemcovia_kampani, odoslane_emaily, samostatne_emaily, prijate_spravy, odhlasenia, odhlasenia_firiem_kontaktov, odhlasene_domeny, stop_list;
  • posts, videos, images and AI: namety, prispevky, prispevky_na_sietach, media, videa, verzie_videi, zabery_videi, postavy, avatary, hlasy, ai_navrhy, ai_pomoc;
  • advertising: reklama_profil, reklama_navrhy, reklama_kampane, reklama_media, reklama_leady, reklama_suhlasy and further advertising records, if the company has them in the service;
  • contract: baliky, naroky_na_mieru, objednavky, suhlasy_objednavok, promo_kody_objednavok, potvrdenia_objednavok, faktury, nakupy_dokupeni, odstupenia, zrusenie_firmy;
  • CRM (pipeline, notes, reminders, contact labels and automations): lievik, stadia, historia_stadii, poznamky, pripomienky, stitky_kontaktov, stitky_na_firmach, stitky_na_ludoch, automatizacie, udalosti_crm, behy_automatizacii;
  • loyalty programme (programme, levels, rewards, members, movements, pending sign-ups, consents to news, till devices and staff without fingerprints and PINs): vernostne_programy, vernostne_urovne, vernostne_odmeny, vernostni_clenovia, vernostne_pohyby, vernostne_prihlasky, suhlasy_kontaktov, pokladna_zariadenia, pokladna_obsluhy;
  • settings: nastavenia, zmeny_nastaveni;
  • clenovia (members): e-mail, name, role, status and time of addition of each company member, without passwords.

Images and videos: in the media section, each file has a url field with the file's address on the domain link.plus.contact. The files themselves are not in the JSON; you download them from these addresses. The address works without logging in for anyone who knows it, so do not send the export to anyone. The service deletes the files of published or rejected videos from the server after 30 days (Article 5.3); the video record remains, the file does not.

What the export does not include:

  • passwords, access tokens, token hashes and encrypted values; columns with such data are always omitted;
  • secret settings, for example SMTP and IMAP mailbox passwords; in the settings change history their value is empty;
  • login details for social networks and ad accounts, internal links to the payment gateway and to ad accounts, and records of ad account creation;
  • sessions, pending logins and the registration record with the token hash (security);
  • the operator's technical records and costs (consumption of AI and services, call counters, records of video generation at the supplier), the mechanics of allowance consumption (the status follows from the package and purchases) and the mechanics of mailbox reading;
  • derived summaries and counts whose underlying data is in other sections;
  • notifications in the bell (deleted after 90 days) and voice command sentences (deleted after 30 days);
  • the operator's measures (restriction of sending, switching off advertising) and the record of advertising e-mails;
  • the record of sending the top-up confirmation by e-mail (to whom and when it was sent; the purchase itself is in the nakupy_dokupeni section) and the record of the notification of a failed invoice payment (the invoice is in the faktury section).

2. Contacts in CSV and XLSX format

Who and where: every user of the company in the Companies and People lists (also in the list of undeliverable addresses) via the CSV and Excel links. The file contains all records according to the currently set filter, without pagination.

CSV: UTF-8 encoding with BOM, semicolon separator, lines terminated with CR LF, column names in the first row. Multiple values in one cell (for example several e-mails or telephone numbers) are separated by a vertical bar with spaces.

XLSX: a single sheet; the first row with the column names is frozen and has a filter.

Columns: for companies, for example name, legal name, company ID (IČO), telephone numbers, e-mails, website, address, source and identifier; for people, name, position, company, city, telephone numbers, e-mails, e-mail confidence, source and identifiers.

Limitations: CSV and XLSX contain only the fixed set of columns of the list. Custom fields, campaign history, unsubscribes and other data are available only in the JSON export.

3. Help with switching

If you need help with switching to another provider or your data in a different format, write to us at quick@plus.contact (Article 21a.2).
